  1. NOT A LEASE: In Accordance with Wisconsin State Law, this Seasonal Rental Agreement is not a Lease of Real Estate and the above listed occupants are listed as Camper(s) and are not Tenants of Sand Haven Campground. The address of this park cannot be used as a permanent address, mailing address, voting address, or for registering in local schools.

  2. CAMPSITE: This Rental Agreement is defined for the above-mentioned Campsite number. Camper(s) shall have exclusive lodging at this Campsite. Included at the Campsite is 1) an electrical connection which provides domestic electricity not exceeding 50 amp. 2) A water supply line which is connected to a private water well. 3) A connection to private on-site wastewater treatment system or service to empty transfer tank on the Camping Unit which holds greywater generated by Camper(s).4) Each site is supplied with a back flow preventor (BFP) on the water spicket as required by the State of Wisconsin regulation DHS178.14(4c). The BFP must always remain intact as a preventive measure against contamination of the water supply. The BFP's are owned by Sand Haven Campground and shall not be altered in anyway, shape, or form. You will experience water output when turning water on or off. This is normal.

  3. CAMPING UNIT: A single Camping Unit, not to exceed 400 sq/ft, is permitted per Campsite. A Camping Unit may consist of a single trailer, motorhome, pop-up trailer, park model RV, or other recreational vehicle which has been approved by Sand Haven Campground. Only a Camping Unit that has been certified by the Recreational Vehicle Industry of America and is less than 15 years of age may be placed at the Campsite. Should a Camping Unit exceed 15 years of age while placed at the Campsite, Camper(s) agree to removal of the Camping Unit at the end of that season. Sand Haven Campground reserves the right to accept a Camping Unit greater than 15 years old with or without conditions, which must be agreed in writing and signed by Sand Haven Campground.

  4. RENTAL PERIOD: Upon payment of all fees, this rental period shall commence on the 3rd Friday of April and end on the 3rd Sunday of October for the previously stated year (weather permitting). Upon fulfillment of this term this agreement shall expire, and a new agreement will be required for the following season.

  5. LIMITED-ACCESS PERIOD: Access to Campsite shall be allowed from the last day of the Rental Period to the 2nd Friday of November. This period is for shutdown and maintenance of Camping Unit for returning guests only. No amenities or services shall be available at this time. Water and/or sewage access may not be available at this time depending on weather and at the discretion of Sand Haven Campground. If you wish to enter your site before and after the dates stated, please notify Sand Haven Campground.

  6. AGREEMENT TERMINATION: Unless otherwise signed, termination of this rental agreement will occur at noon on the third Sunday of October of the current season. All Camper(s) items must be removed by this time if not returning for the following season. Any items left behind will be considered abandoned. Camper(s) shall be responsible for fees through the end of the Rental Agreement period.

  7. RENEWAL OF AGREEMENT: Camper(s) have a right to renew their Seasonal Campsite by the first Sunday of September of the current season. Any site that has not had a signed agreement and reservation fee entered by this date, the site will be marketed.

  8. EARLY TERMINATION: A written notice is required to vacate the Campsite if the date is before the end of the rental period. Camper(s) shall be responsible for paying fees and expenses for the Campsite for the remainder of the Rental Agreement period or until the Campsite is successfully re-rented.

  9. CAMPSITE FEE: The Campsite Fee is due on or before the 1st day of April. A fee on each check not clearing the bank will be charged (the maximum service charge allowed by state law). When a returned check results in late payment the NSF fee will be assessed and is subject to civil penalties. Sand Haven Campground reserves the right to apply monies received in the following order: 1) reservation fee; 2) NSF fees; 3) repair expenses; 5) attorney's fees; 6) Campsite fees.

  10. RESERVATION FEE: A fee of $500 must be received before the signing of the Rental Agreement. This fee reserves the assigned Campsite and allows for storage of a Camping Unit outside of the Rental Period at Sand Haven Campground Inc.'s discretion.

  11. CHANGE OF INTENT: When an agreement for the following season has been signed and a reservation fee has been paid and renter decides not to return, Sand Haven Campground must be notified in writing by January 1st of the agreement year so the site can be marketed, or renter will be liable for all remaining fees per the agreement unless the site is re-rented. When a current seasonal guest moves to the site in question and their site remains available you are liable until site(s) are rented. If the site(s) are re-rented at full price your $500.00 site fee can be reimbursed minus a $25.00 handling fee. All property on the site must be removed as soon as possible, weather permitting and at the discretion of Sand Haven Campground no later than April 1st or your property will be removed from your site and you will be charged a fee of $50 per day and the $500 reservation fee will be applied. All items from campsite shall be held for 30 days. Should any items not be claimed they shall be sold or disposed of.

  12. UTILITIES: Each Campsite is supplied with an electric meter owned by Sand Haven Campground. Tampering with or altering any electrical equipment is strictly forbidden. A facility charge of $10 plus metered Kw is charged and due for each month. A late fee of $10 shall be applied for any payment that is 10 days after the due date. An additional $25 shall be applied for any payment that is one calendar month after the due date.

  13. GRAY OR BLACK WATER: Any ground disposal of drain water (gray or black) is prohibited by State Law! All waste water from Camping Units (including sink water) must be disposed of into the sewer drains or containment systems. If you are found in violation you will be asked to leave the campground immediately without a refund.

  14. DEFAULT/REMOVAL FROM CAMPSITE: Should Camper(s) fail to pay fees or violate any material term of this agreement or rules, Sand Haven Campground reserves the right to require immediate removal from the Campsite.

    • Upon receival of removal notice, Camper(s) and their guests are to vacate Sand Haven Campground immediately. Failure to leave the Campsite immediately shall be liable for liquidated damages of $100 per day. Camper(s) shall have 10 days to schedule a time to remove Camping Unit and clean the Campsite. A date and time must be approved by Sand Haven Campground.

    • If a removal notice is given, Camper(s) are responsible for paying the full amount of the fees and expenses associated with the Campsite for the remainder of the Rental Agreement term, to include full period, or until the Campsite is successfully re-rented.

    • Any items not removed from the Campsite at this time will be considered stored at Campsite or moved to a storage location. A storage fee of $50 per day shall be applied in addition to the cost of moving items to a storage location. All items shall be held for 30 days. Should any items not be claimed they shall be sold or disposed of.

    • In addition, the Camper(s) are responsible for all attorney's fees and court costs incurred to enforce the terms of this agreement.

  15. OCCUPANCY: Campsite is rated for up to 4 people or one immediate family and cannot exceed 6 without prior approval whose names are registered with Sand Haven Campground. All occupants agree to abide by all Rental Agreement terms, rules, and regulations as established by Sand Haven Campground. Subletting and assignment by Camper(s) is prohibited. Camper(s) shall not do things that disturbs the occupancy of other Camper(s). Camper(s) agrees to abide by all local, state, and federal regulations, ordinances, statues, or laws. Camper(s) consents that use of these premises is limited to camping. Camper(s) shall not use these premises for disorderly or unlawful purposes. Camper(s) agree to promptly provide written notice to Sand Haven Campground of any conditions on the premises that are dangerous to health or safety of Camper(s) or other Camper(s), or which may require repair.

  16. LIABILITY AND INSURANCE: Sand Haven Campground requires that Camper(s) obtain proper insurance on private Camping Unit, structures, golf cart, boat, vehicles, and any other item of value. Camper(s) shall not be considered co-insured with Sand Haven Campground under any property insurance. Sand Haven Campground and its agents are not responsible for any injury to Camper(s) or Camper's guest(s) or damage to the property of Camper(s) or their guest(s) that was not caused by a willful or negligent act of Sand Haven Campground. Sand Haven Campground and its agents shall not be liable for damages, or off set to Campsite fees caused by plumbing, water, or sewage intrusion, or for any temporary interruption of utility or service provided to Camper(s).

  17. CAMP AT YOUR OWN RISK: Camper(s) are aware that Sand Haven Campground offers recreational opportunities in an outdoor setting. Because Sand Haven Campground's setting is natural environment, the Wisconsin Legislature has adopted section 895.519 of the Wisconsin Statues, which grants Sand Haven Campground immunity from liability for the inherent risks of camping activity. Camper(s) acknowledge they accept the Inherent risks of camping. Camper(s) are aware that they will be unable to recover damages against Sand Haven Campground for the inherent risks of camping even if the Camper(s) or their guests are injured or killed as the result of these inherent risks.

  18. MODIFICATIONS AND/OR DAMAGE TO PROPERTY: Camper(s) shall not decorate or modify premises without Sand Haven Campground's written consent. Any maintenance expenses and damage due to neglect or carelessness by Camper(s) shall be reimbursed to Sand Haven Campground. Expenses not immediately paid by Camper(s) shall constitute a violation of the Seasonal Rental Agreement. Camper(s) is responsible to maintain premises in a clean and neat manner. Camper(s) is responsible for expenses incurred for failing to report needed repairs to management.

  19. PETS: Only with Sand Haven Campground approval, a signed pet addendum, and a paid pet fee(s), 2 dogs or cats will be allowed at Sand Haven Campground. No visitors of Camper(s) are permitted to bring pets to Sand Haven Campground.

  20. JOINT & SEVERAL LIABILITY: Liability of any & all signers shall be joint and several, and a judgement entered against one shall be no bar to action against the other(s).

  21. DAY GUESTS/VISITORS: In accordance with Wisconsin State law DHS178.21(2), all guests must register with Sand Haven Campground. Campsites cannot exceed 6 people without prior approval. All guests and visitors will be charged a $5 daily fee if using campground amenities. We will allow 2 guests to use amenities at no charge.

    • It is at Sand Haven Campground's discretion to allow more guests for special events only.

    • Guests of Camper(s) are expected to follow parking rules (see Rules and Regulations).

    • All Visitors must depart Sand Haven Campground by 11PM. Day Guests/Visitors are not allowed to being pets.

  22. ABANDONMENT: Any objects or possessions left on the premises after vacating are considered abandoned by its owner and will be disposed of as state law permits. Camper(s) relinquishes all claims and releases Sand Haven Campground from any claims arising from storage or disposition of said property. This shall apply even if the property left abandoned exceeds $2,500.00 in value.

  23. GRILLS: Camper(s) agree to keep grills 10 feet from any Camping Unit, building, or gas or propane storage.

  24. GOLF CARTS: Only electric golf carts are permitted on Sand Haven Campground property. Golf carts must be operated by a licensed driver only. Camper(s) must carry adequate insurance coverage on their privately owned golf cart. The maximum number of passengers must not exceed the number of seats. All passengers must be seated while the golf cart is in motion. All golf carts must have working lights both in front and back and a horn. No horseplay or reckless driving is prohibited.

  25. DRUG-FREE AND CRIME-FREE CAMPGROUND: Occupant, any member of the occupant's Campsite or a guest or other person under the occupant's control shall not engage in criminal activity, including drug-related criminal activity, on or near the said premises. (a defined in Section 102 or the Controlled Substance Act [21 U.S.C. 802]). Occupant, any member of the occupant's Campsite, or a guest or other person under the occupant's control shall not engage in acts of violence or threats of violence, including but not limited to the unlawful discharge of firearms, on or near the Campsite. VIOLATION OF THE ABOVE PROVISIONS SHALL BE A MATERIAL VIOLATION OF THE RENTAL AGREEMENT AND GOOD CAUSE FOR TERMINATION. It is understood and agreed that a single violation shall be good cause for termination of the Rental Agreement. Unless otherwise provided by law, proof of violation shall not require criminal conviction, but shall be preponderance of the evidence.

  26. RULES AND REGULATIONS: Camper(s) acknowledges that the rules and regulations are considered terms of the Rental Agreement. Any breach of the rules and regulations is a violation of material term in this Rental Agreement. Sand Haven Campground reserves the right to make modifications to the rules and regulations. By signing below Camper(s) acknowledge that they have read a copy of the rules and regulations and/or can request a copy of the rules and regulations at any time. The rules and regulations can be found on the website at www.sandhavencampground.com.

  27. PHOTO RELEASE: By signing this Rental Agreement, Camper(s) grant Sand Haven Campground, its representatives and employees, the right to take photographs and/or videos of Camper(s), their guests, and their property in connection with normal use of the campground. Camper(s) authorize Sand Haven Campground to use such photographs and/or videos with or without Camper(s) name for any lawful purpose without prior notice.

This Seasonal Rental Agreement is not valid until signed by Owner or Operator of Sand Haven Campground. This Seasonal Rental Agreement, along with rules and regulations, contains the entire agreement between the parties. No oral agreements have been entered. Sand Haven Campground shall treat all Camper(s) equally without regards to any protected categories under Federal and State Laws.
